This Agreement is governed by the laws of the State of North Carolina. Any disputes arising from this Agreement will be adjudicated in the courts of Mecklenburg County, North Carolina.

1. Scope of Application

This Agreement applies to all services and products provided by Her Work Essence, including but not limited to coaching, workshops, subscription services, digital products, books, memberships, and other related offerings.

2. Age Requirement

Participation in Her Work Essence services and products is restricted to individuals 18 years of age or older. By enrolling or purchasing, you confirm that you meet this age requirement.

3. Financial Commitments

a. Payment Terms

All fees are due in full at the time of booking or purchase unless otherwise stated in writing.

b. Refund Policy

Payments are non-refundable unless explicitly stated in the terms of a specific program or service. Refunds, if applicable, will be processed according to the method of original payment.

c. Transfer of Services

Programs and services may not be transferred to another individual unless explicitly approved in writing by Her Work Essence.

d. Non-Transferable Products

Books and digital products sold by Her Work Essence are strictly non-transferable. Upon purchase, the Client is granted a non-exclusive, personal license to use the product. Resale, sharing, or any transfer of ownership of these materials is prohibited and will constitute a breach of this Agreement, subject to legal recourse.

4. Subscription Services

a. Recurring Payments

By enrolling in subscription-based services, you authorize Her Work Essence to charge your payment method for recurring payments in accordance with the subscription terms provided at the time of enrollment.

b. Cancellation

To cancel a subscription, you must notify us in writing by emailing hello@herworkessence.com at least five (14) business days before the next billing cycle. No refunds will be issued for any portion of the billing cycle already paid for.

c. Program-Specific Terms

Certain subscription programs may have unique cancellation or refund policies, as stated in the program’s terms.

5. Code of Conduct

All participants are expected to adhere to the following guidelines:

• Respect the confidentiality of other participants.
• Refrain from disruptive, harmful, or inappropriate behavior.
• Maintain a positive and inclusive environment.

Her Work Essence reserves the right to terminate participation in any program for violations of this Code of Conduct, with no refund provided.

6. Intellectual Property

All materials provided by Her Work Essence, including books, digital resources, course content, and session materials, are the intellectual property of Smile and Live, LLC. Unauthorized reproduction, distribution, or commercial use is prohibited.

7. Privacy and Data Protection

Her Work Essence collects and processes personal information in accordance with applicable laws, including the North Carolina Identity Theft Protection Act and other relevant privacy laws.

• Data Collection: Personal data is collected for the purpose of delivering services, processing payments, and communication.
• Your Rights: You may request access to, correction of, or deletion of your personal data by contacting hello@herworkessence.com.
• Third-Party Services: Her Work Essence may use third-party services (e.g., payment processors) that operate under their own privacy policies.

8. Disclaimer

Her Work Essence provides educational and personal development services. These services are not a substitute for professional medical, psychological, legal, or financial advice. Clients are responsible for seeking professional assistance when appropriate.

9. Limitation of Liability

To the fullest extent permitted by law, Smile and Live, LLC (dba Her Work Essence) is not liable for any damages, including but not limited to loss, injury, or indirect damages, arising from participation in its programs, use of its products, or reliance on its services.

10. Governing Law and Venue

This Agreement shall be governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Mecklenburg County, North Carolina.

11. Amendments

Her Work Essence reserves the right to amend these Terms and Conditions at any time. Changes will be communicated to Clients via email or updates on our website. Continued participation after updates constitutes acceptance of the revised terms.
